These Terms of Service (the “Terms”) govern your access to and use of the Pendragon’s Smokehouse website (the “Site”) and any purchases made through the Site. By using the Site or placing an order, you agree to these Terms.

The Site is operated by Bark and Oak LLC, doing business as Pendragon’s Smokehouse (“Pendragon’s,” “we,” “us,” or “our”).

2) Eligibility and Use of the Site

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through the Site. You agree not to misuse the Site, interfere with its operation, or attempt unauthorized access to any systems or data.

3) Orders, Pre Orders, and Cutoff Times

We prepare items to order and schedule production based on your selected delivery date and time window. Orders become binding once submitted and accepted by us.

Order cutoff times, delivery dates, and available time windows are displayed during checkout or on the relevant page. Orders placed after the cutoff for a given delivery date may be scheduled for a later date or declined.

4) Pricing, Taxes, and Payment

All prices are listed in U.S. dollars unless stated otherwise. Prices, product availability, and menu items may change at any time without notice.

You authorize us (and our payment processor) to charge your selected payment method for the total amount shown at checkout, including any applicable taxes, fees, or delivery charges. If your payment cannot be processed, we may cancel the order.

5) Delivery Routes, Time Windows, and Address Requirements

Delivery is available only within our active delivery routes and service areas as displayed on the Site. You are responsible for providing an accurate delivery address and any required delivery instructions.

Delivery times are provided as estimated time windows, not guaranteed appointment times. Delays may occur due to weather, traffic, operational constraints, or other factors outside our reasonable control.

If we are unable to complete delivery due to an incorrect address, access issues, inability to contact you, or other customer related delivery failures, we may treat the order as completed for purposes of payment and refunds, subject to our Refund Policy.

6) Food Product Considerations, Handling, and Reheating

Food is perishable. You are responsible for promptly receiving and appropriately storing and reheating food after delivery. We are not responsible for quality issues caused by delayed retrieval, improper storage, improper reheating, or failure to follow instructions provided on the Site or packaging.

7) Allergens and Dietary Information

We may provide ingredient and allergen information for convenience, but we do not guarantee any item is allergen free. Our kitchen may handle common allergens, and cross contact may occur.

If you have food allergies or dietary restrictions, you are responsible for reviewing product information and contacting us before ordering if you have questions. You assume all risk associated with consuming our products, including risks related to allergies or sensitivities.

8) Refunds, Cancellations, and Order Changes

Because items are made to order, refunds are not offered as a standard option, especially for cancellations after the cutoff time. Our refund and remedy options are described in our Refund Policy, which is incorporated into these Terms by reference.

9) Promotions, Discount Codes, and Store Credit

Promotions and discount codes may be limited by route, date, inventory, customer eligibility, and other conditions disclosed at the time of offer. We may modify or discontinue promotions at any time.

Store credit, if issued, has no cash value and may be subject to additional terms communicated at issuance.

10) Intellectual Property

All content on the Site, including branding, logos, photography, copy, recipes, designs, and other materials, is owned by us or licensed to us and is protected by intellectual property laws. You may not copy, distribute, modify, or exploit Site content without our prior written permission.

11) Disclaimers

The Site and all products and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement.

12) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or your purchase or consumption of products.

To the extent liability cannot be excluded, our total liability for any claim will not exceed the amount you paid for the applicable order giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless Pendragon’s Smokehouse and its owners, employees, contractors, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorney fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third party rights.

14) Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of laws principles. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Essex County, NJ, and you consent to their jurisdiction.

15) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above indicates when changes were made. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
